Bringing parents to UK for a short visit

Post by otuwa » Tue Jun 27, 2017 3:08 pm

Hi

My parents, me and my brother came to UK in 2005 to study. My mother completed a PhD and then my father got an offer letter from a reputable university to carry out a PhD from a reputable UK university. However, despite having enough money and a CAS letter, home office refused him VISA. Their reason to reject the application was they were suspicious that he might only do a PhD to settle in UK. After the application was unsuccessful they went to Sri Lanka and settled down where my father retired and my mother still works as a senior lecturer.

When my brother graduated from the university they applied for visa once again to attend the graduation ceremony. This was after 2 years of they refusing visa for my father. Again the UKVI turned down their application saying that they might not return back to their country despite my mother having a full time job and properties in Sri Lanka.

Since then two more year have passed and me and my brother are British Citizens now. We have not seen our parents for like 4 yeas now and I really want them to come to UK for at least 2 weeks just to stay with us and travel around the country.

Can I apply for a visa for them from the UK? I really do not want another refusal as they will go back after the visit and they have never broken any immigration rules when they were studying in UK previously. Any help in this regard would be much appreciated.

As I advise my friends, there is no guarantee someone will receive a visit visa for sure. This is because a visitor visa is NOT based on points based system. It is very subjective and depends on whether the case worker gets convinced based on evidence being produced by your application
All you can do is apply with adequate documentation on your parent's family ties and financial stability back home and pray for the best.

Best of luck

@poper Thanks a lot for the reply. We are worried about getting rejected for the third time? Will this have any negative impact on future visitor visa applications?

Every application is decided based on its own merits. His previous refusals will flag whenever he applies for a UK visa
He has already been refused a couple of occasions. Its cannot get worse than this.
Try applying again. You may or may not get it.

Worst case, you will need to visit them.

Will we have a better chance of approval if we submit the application forms from UK?

How are you going to do that? They must apply in their home country, it makes no difference who completes the form as to whether they will be successful or not.

I have gone to the citizen advice website and apparently there is an option where the UK citizens can apply visa on behalf of a family member. Please see the link to the website

Is this correct information?

That is only you completing the forum for parents. Your parents still have to submit the forum with all their evidence of their circumstances in their home country. You completing the forum doesn't give it any advantage for approval.

Previous visa rejections must be declared, regardless of who completes the form.

Right ok. Hmm... rather than both my parents coming together will it be better to invite only one of them at a time? Will this strengthen the application as this will show stronger ties to Sri lanka and reduce the chance of a refusal?

You said you are now British Citizen. You can apply their visa via UK Solicitor. In the mean time prepare all documents and make sure to submit all the necessary documents to show your parents will be returned on time.

Refusals will not effect any future application until or unless the application fall under deception. Also you both brother write a Invitation Letter and in the letter you can show your job. If you are supporting your parents financially so make sure you are not claiming any state benefits. If your parents are supporting themselves so they can proof by submitting their source of earnings and bank statement least 6 months.

I also advise you if you parents got their visa so they must return to Sri Lanka on time. For example if they applied for 2 weeks so they must be returned with in 2 weeks. It will help them to get visa easily in future.

Thanks a lot for the reply.
I was wondering whether using a solicitor from UK will make the application any stronger? Last solicitor I asked said he will charge £800 for one applicant with no gurantee that the application will be successful. Also if one of my parents apply first will that improve the chances of getting VISA?
