FLR M APPEAL

Post by Sva_avs » Thu Jun 29, 2017 3:15 pm

I applied for ILR switching from Tier l General. I applied my wife dependant application under FLR M

HO rejected my wife visa stating still I am not having settlement visa. so I appealed saying she is my dependant and I am main applicant.

Now I got my ILR and I got my wife appeal for hearing. My ILR status will help to get her visa.

Please suggest

Did you ask them to put it on hold?

Do you have children, and do you meet the financial requirements.

It makes no sense making an FLR(M) application which your wife did not succeed under, and not asking them to put it on hold until your residence issue is resolved.

Or

Is it best to withdraw the appeal and reapply

Appeal may well be allowed under or outside the rules.

If you applied for ILR based on Tier 1 and 5 years residence, why didn't you opt to extend your wife's Tier 1 dependent visa instead??

Has her Tier 1 dependent visa already expired?

She did not have to switch to FLR(M) unless you got ILR based on 10 years long residence.
