My wife and I have been applying for her to stay here since we got married in 2011. Twice in that time we've had to apply for a 2 year extension (as opposed to ILR) as the first time she hadn't passed her knowledge of life in the UK test in time, and the last time as her English language exam was no longer eligible - we had the decision back a few months ago.

My wife has now passed an English test at an approved provider. I'm assuming that we can now apply for ILR (as we did last time) even though it's not within 28 days of her current 2 year extension expiring? If anyone could confirm this, that would be great

Did she do the B1 English test?

If yes then she can apply when ready.

Yes she did. Things have changed so much over the last few years that we just want to get her ILR approved now before things change again. Even though it will cost about an additional £2300 having not long ago paid that for the 2 year extension it'll be worth it to not have the on-going anxiety about her long term status here
