Tier 5 to Tier 2 General dependent

Post by cremewong » Sun Apr 09, 2017 1:23 pm

I've been looking for answers on UK Visas and Immigrations and I'm still not sure about it. So any advices would be greatly appreciated! :)

I'm on Tier 5 Youth Mobility Scheme and my visa runs out in August. My husband is on Tier 2 General and I'm planning to stay in the UK as his dependant. Does anyone know if I can apply for dependant visa in the UK without going back to my home country to apply from there?

Below is what I've found on UKVI website but it also mentions that people on tier 5 YMS cannot switch to other visa categories so I'm not sure...

Applying as the Family Member of a Tier 1, 2 or 5 migrant in the UK
33.If you are the family member of a Tier 1, 2, or 5 migrant, you cannot apply in the UK if you:
 were last granted entry clearance or leave as a visitor, including where they entered the United Kingdom from the Republic of Ireland to stay under the terms of articles 3A and 4 of the Immigration (Control of Entry through the Republic of Ireland) Order 1972 (as amended by the Immigration (Control of Entry through Republic of Ireland) (Amendment) Order 2014) on the basis of a visa issued by the Republic of Ireland authorities endorsed with the letters “BIVS” for the purpose of travelling and staying in the Republic for a period of 90 days or fewer; or
 were last granted entry clearance or leave as a short-term student or a short-term student (child)
 were last granted entry clearance or leave as a parent of a Tier 4 (child) student
unless the Relevant Points Based System Migrant has, or is being granted, leave to remain as a Tier 5 (Temporary Worker) Migrant in the creative and sporting subcategory on the basis of having met the requirement at paragraph 245ZQ(b)(ii); or
 are on temporary admission or temporary release.

Yes you can switch if not in the two categories of tier 5 listed.

Tier 5 YMS to dependent visa

Post by cremewong » Sat Jul 01, 2017 6:13 pm

Hiya,

I’m currently on a Tier 5 Youth Mobility Scheme visa, which is running out in a month’s time. I recently got married and my husband is on Tier 2 general leave to remain category. I was under the impression that I could apply for Tier 2 dependant now that I’m married but I’m stuck with this particular question in the online application form. The question is ‘are you currently a dependant of a points based migrant’. If I say yes to this one does that mean I currently hold a dependant visa under my husband’s category? If I say no to this I cannot proceed with the application. Just to check, I clicked on yes and proceeded with the application but at the end it doesn’t even mention about the marriage certificate as required evidentiary document hence I’m baffled if I will have to apply from my home country?

Any help is greatly appreciated.

This thread is 18 months old and member cremewong only posted twice and hasn't visited the forum since Jul 01, 2017 . I suggest you open your own topic and post your questions there :!:
