Home office presenting officer , no bundle no appearance

I have an appeal for FLR (fp) parenr routeI had court on Friday, I got to court to find out home office didn't send their bundle (concerning my case) to tribunal and they didn't even appear that day. Please what could be the problem please moderators I need your advice.

Moderators don't know, as they were not in court.

The judge will decide how to proceed.

Sometimes judge will adjourn and sometime he will proceed.

Thank you for your reply. As you said, the receptionist advised it wil be adjourned for a later date (2-3montha)

Please do you have any idea why home office would just decide not to send a bundle and not show up

It's possible HO just neglected to. They're presently failing to fulfil their duties left and right to be honest.

Just an update incase anyone is in my situation:

I got a bundle from HO and letter from court and the hearing is in Aug.

I had my hearing on 30 aug. And HO representative didnt appear but they did send bundle. Judge proceeded without them, hearing was done all good and after 5 days i got a letter saying that my appeal is allowed by judge. They put two objections on my one overstayed( which i wasnt i dont knw how ho kept claiming that i had all the letters sent to me time to time and when we showed them to judge the judge agreed. My english test was the other objection which judge said that previous test (ETS which caused me a lot of problems but i was given in country appeal and i won the appeal) must be accepted. Now waiting for HO to respond. Judge said that HO was full of flaws in my case. I just hope they dont appeal

Hi,

I will say a BIG CONGRAtulation to you. You shouldn't worry now ( about they appealing) because they really are not interested in cases like yours cz they know they will lose ( if they go to the UT). After 10 days (of which you got your letter from the court) you should start contacting them because they don't send documents on time. Welcome to the ship LOL (waiting for mine as well) . Please keep us updated .I will let you know when I get mine too anyway.

Hello Brother,

i won the the case outside the immigration rule. jugde was very disspointed with the HOPO because his only objection was for me to take my son back to my country for entry clearance (because i was on visit visa) which the jugde clearly told him that is not reasonable . i wish you all the best bro, i am sure you will be fine in the hearing so far no criminal records or application deception, you hearing will be more straight forward.

i have been through appeal process previously where judge allowed my spouse visa within uk, home office implemented it and i had 2.5 years visa which expired in may 2016. When i applied for extension home office refused me saying you only lived in uk for 6 months when i legally staying in uk since january 2009. so i am going through appeal process again. Waste of money and time.
So far the ground i have are
my british partner, paying tax regularly as we both are in professional jobs. Will be becoming father next month In shaa Allah.Wife's all family in uk. most of my family in uk as well. 

Lets see how judge looks at all these proofs. Most interesting thing is i will be going to same court which gave me visa 2.5 yrs ago

Congratulations mate, i am hoping they dont appeal against it , its been 3 years i am into this thing and really suffered alot throughout, am desperate to get my visa so that i can live a normal life instead of being worried all the time. Please keep in touch and keep me updated about your case. And any tips if you have, i dont know how long they going to take if they didnt appeal

We didn't actually proceed to the hearing date. Three days before the hearing date, i was informed by a letter that the hearing date has been adjourned so I called the tribunal to get an update and they said this was because HO didn't send the bundle to us, therefore the judge didn't have anything to look at. Me and my solicitor didn't receive the bundle either. I was wondering if this may lead to withdrawn the case by HO...Would appreciate if we could exchange some thoughts regarding to that. Thank you!

Just a quick update for anyone in my situation,
I've been given a hearing date on February 24th 2018. I was advised by my soliciter that HO sensed that they will lose the case that's why they didn't send the bundle which resulted to an adjournment. They might not even show up in the hearing date... I just hope that they won't withdrawn the decision so we could actually proceed to the hearing date...
