If however on the day the application reaches a caseworker, you have acquired 5 years residence, then you application will succeed.

At present for a residence card, this is taking about 5 months for it to reach the caseworker's desk. Therefore it is highly likely that you will have accrued the required period of residence before the application is looked it, and it is open to you to send any further evidence until then.

Under EU law, a person need to satisfy the caseworker, that on the day of the of the assessment they are entitle to the confirmation they sought. If they can, then they will be entitled to succeed.
