Tier 2 extension

Post by black_pearl » Mon Jul 03, 2017 8:00 pm

Dear All,
I have following questions, the clarifications of which will be greatly appreciated:
I have been in UK since Feb 2009 but had to return to my home country for one year from Nov 2011 till Dec 2012 to complete house job and have been here since Dec 2012. Initially, I was on PSW Dependant--> Tier 2 Dependant--> Tier 2 Main applicant since 2014. My current Tier 2 is expiring in Sept 2017 and I need to extend for another two years to be eligible for permanent residence but my current employer's policy is to give COS until only the duration of training which in my case is until Feb 2018. I have following options in my mind about how I can extend my stay:
1: I have asked the employer if they can provide extension for two years and am waiting for their response though looking at their policy, this options seems a bit unrealistic.
2: My husband is on ILR and has applied for british passport and currently waiting for the outcome of his residency application. I can potentially switch as his dependant but this will set my clock back and I will have to wait another five years in order to be eligible. is this a better option?
3: I have a 7 year old who is british citizen and I think I can apply on child's behalf as well but not sure if its the right way to do it.
4: I will complete 10 years in Feb 2019 but there is a one year gap where I had to go back to complete my internship even though I had valid UK visa through out that period. will the time I spent away mean that I am no longer able to apply through the 10 year route?
Your timely and valuable response will be much appreciated and eagerly awaited.

Doesn't seem like they will. This is besides the fact that they will also have to provide you with a particular letter regarding ongoing employment for the foreseeable future when you get to ILR stage and you will have to meet the stringent £35,800pa salary (if you don't already).
2: My husband is on ILR and has applied for british passport and currently waiting for the outcome of his residency application. I can potentially switch as his dependant but this will set my clock back and I will have to wait another five years in order to be eligible. is this a better option?
Yes but you will be free to work (or not work) for whoever you choose.
3: I have a 7 year old who is british citizen and I think I can apply on child's behalf as well but not sure if its the right way to do it.
Difficult to get and take well over a year to decide and mostly ends in refusal.
4: I will complete 10 years in Feb 2019 but there is a one year gap where I had to go back to complete my internship even though I had valid UK visa through out that period. will the time I spent away mean that I am no longer able to apply through the 10 year route?

No, you don't complete 10 years in 2019. You had a year long absence from the UK. Your clock for 10 years long residence starts again in December 2012 when you returned.
