Help Needed! - Asylum Seeker in Common Law Relationship

Post by vj773910 » Tue Jul 04, 2017 3:17 am

Hi, I'd be grateful if anyone can advise me.

Me and Relationship Background
I'm a Asylum Seeker since last July 2016 and my case is still pending.
I'm in a relationship with my partner for more that 4 years and now I'm in a "Common Law Relationship" for nearly 2 years.

I believe i'm eligible for a Private Life but some are stating i'm not eligible since i'm a Asylum Seeker.
Can anyone advise me which is the truth?

Regards,
VJ

What is your partners nationality?

Why do you believe you qualify for an application based on private life?

Hi,

My partners nationality is British.

Please refer this link:
https://www.gov.uk/uk-family-visa/partner-spouse

My doubt is, my case has no update till now.
Can i make a new application based on "Family visas: apply to live in the UK" or
wait until my Asylum case is heard and provide this as extra evidence. But don't know when i will get any updates on this. I personally know some have waited for more than 7 to 8 years.

Please advise.

When did you come to the UK?

How did you enter the UK, with what visa?

How long have you lived with your partner?

Entered UK in 2009 with Student VISA to finish my masters.
We're completing 2 years in couple of months.

What is your nationality?

Why wait so many years before claiming asylum?

What is the basis of your asylum claim?

Why can you not return home and apply for a unmarried partner visa in the proper way?

I can't see a Private life being successful as unmarried and with no children (assuming no children).
