Visitor visa for inlaws

Post by bss85g » Wed Jul 05, 2017 12:00 pm

Hi
It's my first time posting hope you all can help me.

My in laws have been in the UK on a visitor visa and will be returning to India this week after being here for 5 months. We want to call them over again. My questions are in our sponsor letter we stated they would be coming for 2 months but they then got a ticket for 5 months will this be an issue on the next visitor application we submit?

Will there be an issue in calling them over again in October as I return to work and they would be helping look after my daughter?

And would we be able to call them over indefinitely?

Thanks

1. Yes it will be an issue, viewed as deception.

2. Five months is too long for a visit.

3. You can only visit for 6 months in every 12 (in theory, in practice half a year is too long).

4. Helping with children could be construed as depriving a Uk national of work, so be careful it doesn't appear as free childcare...

5. No chance either before and less chance now the last visit visa was abused.

Plan to visit them, I doubt they'll get another visit visa after this.

So if his inlaws wants to visit them every year, what would be the appropirate time frame for a visitor without getting flagged down for deception?

It's a margin call, suggest one reads others similar stories on these very fora. A definite no-no is asking for a certain period and staying longer, seems that will almost certainly guarantee future refusals.

Remember to that visa validity doesn't mean it's ok to use the whole valid period. Suggestions have been made along the lines of 2/3 week visits twice or so in the six month period.

The background behind all this is as usual, abuse. Visits are just that, not long periods of effective residency.

So that's my suggestion, 2/3 weeks a few times, a year, might get away with more, might not. Hence best to search and read others' experiences.

Thanks for the response.

Does it make a difference if the sponsor letter stated 2 month and the application stated longer?

Yes it does, UKVI will see how long they stated they were staying and how long they did eventually stay.

Hopefully they did not use ANY free NHS while here for 5 months (GP, meds, hospital etc).

Thanks again for your respose.

I read somewhere that even if the sponsor letter stated a 2 month visit it is still up to the officer if he wishes to grant a visa, is this correct?

Yes, the visitor will have to satisfy the IO that he/she is a genuine visitor if questioned....
