Residing in Germany on a UK Tier 2 Visa

Post by Ragerunner » Fri Jul 07, 2017 9:49 pm

Hi,

Was hoping someone might be able to help with potential options for a situation.

I am currently a UK Tier 2 General visa holder.
My work place is fine with me working in Germany for X amount of time.

My passport is Australian so staying in Germany for more than 90 days will max out my schengen travel stay.

Was wonder if there is any possible way I can still be considered working in the UK but be able to stay in Germany. Was hoping for around 1 year.

Any help is appreciated. Thanks!

It isn't just about working in the UK. It is about residing and paying tax and having evidence to prove this etc. Any absence of 180 days or more also breaks your continuity of residence in the UK.

If you are no longer working in the UK for your employer, they are obliged to inform HO about this and your visa will likely be cancelled/curtailed.

And obviously, you will require a work permit for Germany if you plan on working there.

Tax is due where the work is done and the German Finanzamt is the Gestapo in Taxman's clothing, you really do not want to fall foul of them.

Thanks for your responses

I was thinking of not permanently staying consecutively in Germany
but come back to the UK every couple of weeks for a free days and return to Germany and repeat. Not sure if that changes anything

You must be working in the UK on tier 2 general. No way to get around this.

How long to go till you qualify for ILR?

Why Germany, reason??

You have to register your address in Germany and from that the taxman will contact you and want his 56%. Otherwise you are illegal.

Also you cannot work on a Schengen visa, remote or local.

Really do not even think about it, the Finanzamt will come after you and rip you a new one, and stiff you for penalties and interest, big amounts. I know, I've seen them do it to people in my industry attempting to do what you're proposing. Hundreds of thousands of Euros and I'm not even joking and they will jail you for it. They are the most tenacious, unforgiving and combative tax authority in the EU, probably the world.

I can post a link to a thread on another forum about it if it's ok with the mods...
