ILR -Employer letter urgent query please

Post by Sara_wales » Mon Jul 10, 2017 10:14 am

Hi
I am going to apply for ILR based on my tier 2 route next week.
The problem is that my employer is going to issue me a standard letter which they believe they provide to everyone. The letter does not say 'foreseeable future' rather they write the end date of my contract.
Do you think it will be a problem? They said that many people have applied with this standard letter and they were successful.

Best

Yes it will be a problem. The letter should explicitly mention you're still required for foreseeable future.

There have been refusals for this not being stated in the letters.

As a temporary migrant on Tier 2, your contract would always have an expiry date, usually in line with your visa expiry date.

Many thanks guys. I really appreciate your time.
My coleague has applied with the same letter today and his application is successful. So, it's not a hard and fast rule to have these exact words written in employer's letter. This could be useful for other applicants as well. Xx

Your risk, your money to lose if you are not fortunate on the day and get a caseworker who is grumpy and sticks to the rules.

A huge thanks to both of you :)
I have managed to get a letter from my line manager with endorsement of 'required for forseeable future'. Everything what HR has written in their standard letter is in my line manager's letter as well except end date. He only writes that 'Dr xx is employed as a full time employee in xx and will continue to work with us after getting indefinite leave to remain. She will be required on this job for foreseeable future'
Do you think this will be OK, I will be presenting it along with my HR's standard letter.

If it is all the same, on a company letterhead, etc. you probably need to submit only your line manager's letter.
Unless someone else more experienced has a better advice, I think it is better not complicate things by having two letters.
My comments are in no way meant to be advisory. I have no professional knowledge of immigration. These are based on my own experience, convictions and personal interpretation of publicly available information.
