Tier 2- secondary employment

Post by una86 » Mon Jul 10, 2017 10:15 pm

Hello All,

I have just received a job offer from a company allowing a very flexible work contract, but I would still like to maintain a link with my current employer in academia (if possible) where I work as a full-time research assistant. Therefore, I would like to work for the new employer, while changing the contract with current employer from full-time to part-time. I think that both employers would be fine with this. Furthermore, there should be no problem with getting a new COS, or with the salary limits for both jobs.

I have several questions related to the application procedure:

1) Do I need to change my current contract from full-time to part-time prior to new Tier 2 application? Or, can this simply be amended if I receive permission for second employment? When is the best time to talk about this with current and new employer?

2) What is the subject of the application when applying online – change of employment, modification of the Tier 2 status, or something else? Does it differ much (is more complicated) then when applying for change of employer?

3) Is there a maximum total number of working hour per week?

I would appreciate an answer to any of the questions and/or some insight in the application procedure. Is there something that I need to watch out for?

Thanks

You can only work 20 hours a week, in the same field/role in second/supplementary emploment, as your main sponsor job. No need for a new tier 2 as far as I am aware.

You must meet the salary requirement for the SOC for your main job. You cannot work part time for your main tier 2 sponsoring employer, the minimum hours you are allowed to work for your tier 2 sponsor is 30 hours.

Thanks for your reply.

Indeed, I cannot apply for a supplementary job as the new job is not in the same profession (although with the same COS), and it would be for more than 20 hours.

According to the guidelines, I would need to apply for secondary employment. However, nothing is mentioned about working hours for primary and secondary jobs. Both jobs are NOT in the shortage list. The 30 hours limit is indicated for shortage occupations, but the guidelines do not say anything regarding minimal work hours for regular sponsored Tier 2 jobs.

What do you mean by not the same profession but same cos . I guess you meant same profession but not in the same industry. As in same SOC code. If the job is the same SOC you do the second job without applying for a new. Just like CR001 said, you cannot change your main job to part time and you cannot work more than 20 hours for the new job.
You have to keep one as full time and then the other one as part time 20'hours. If you to have both as part time , you might end up losing both.
