I have just received my ILR from Tier2 (5 years), ''thanks for the advice in the ILR forum''.
I have a question about my wife and my 3 year old daughter's status.
they are both PBS dependant on me. Their current visa expires in 15th of August 2017; they will qualify for ILR in February 2018 because my wife has been with me in the UK only since 16th March 2013.
Therefore I only need to extend their stay for 6 months before I can apply for their ILR but it seems like the HO has a default of 3 years extension if the main applicant has ILR. This matters to me for the amount of health surcharge I would have to pay. Do I need to pay 3 years surcharge for them even though they don’t need that length of visa? A friend of mine had similar situation and he says he paid only what is equivalent to one year health surcharge for his wife and her visa was extended for one year (even though he had ILR). Is that something familiar to the seniors or will it just be a risk of rejection?
