Partner of a settled person visa

Post by Raro » Fri Jul 14, 2017 4:30 pm

Please I need help.

And forgive me for the detail
I have a settled status on 20/12/2016 and had my 3rd child (British) on 13/1/17. All my children aged 4.6 years and1.9 years were born in the UK and were living with me and my wife (who has never left the UK since she joined me in 2011) who joined me as a dependent of a tier 4 visa. I have gotten a PhD and she has had Masters in UK university and has registered to practice as a medical doctor in the UK (with General Medical Council) after passing all her professional exams.

I got my current job (total earning £34,000K) and started work on the 10/3/17. But she (my wife) applied for partner visa on the 30/3/17.
Home office wrote us in the first instance that her application is complex and would get back before 16/7/17. They wrote her again on 5/7/17 saying that her application has been placed on hold indefinitely due to the supreme court judgement on 22/2/ 17. Now I have been working and earning enough beyond the £18,600 threshold and she cannot get a job because all employers, particularly for agencies operating locum want her visa before she can start.
This is a difficult time for me and my family and would like to know how to go about this.
I don't know if those who got a new job or those that have not worked upto 6 months before they apply could be considered somehow. Now, she applied 3 weeks after my new job and I have worked for 4 months plus.

What is the way out, any ideas please?

On what basis did you get ILR, 5 years PBS or 10 years long residence?

What was her previous visa and when did it expire?

For the financial requirement, it is mandatory to submit 6 months payslips and 6 months bank statements.

CR001

Thanks for your response.

I got my ILR on the basis of 10 yrs long stay. I have been studying in the UK since 2006. She joined me in 2011 as my dependent and took the opportunity to do her masters and complete her professional exam and now registered to work as a medical doctor.

I just started work on 10/3/17, her visa expired on 31/3/17 but she submitted her application on 30/3/17

As for 6 months bank statement, I have not worked for 6 months but my current work is way above the threshold.

She should have submitted an FLR(FP) 10 year partner route visa application if you did not meet the financial requirement.

I did not use the FLR(FP) , I used the FLR(M) thinking that since I got the job (3 weeks) before I submitted my app, that I am covered. Any idea on what to do?

Please, any idea on what to do next? I am supposed to use the FLR(FP) but used the FLR(M) instead when I do not meet the financial threshold at the point. But now I have met the financial requirements but I have only worked in the current job for 4 months. And I have been told that the application has been placed on hold. Can I resubmit a fresh application. If I am, will I be required to pay another application fees?

You could vary the application to another category.

Please, how do I vary the application to another category?
Do I need to recall the application documents or write a letter to effect that?
