Hi,

I would be grateful if you could please help me with the following 2 questions.
1. I got my 1st Tier 2 visa on 25/09/2012 in UK when I was on my T1 post study work visa. My T2 visa 5yrs qualifying period will be on 25/09/2018. My current T2 visa is valid until Sep 2019.
Can I apply for ILR on 01/09/2018, 24days before the qualifying period?

2. My wife is on T2 dependent visa since Aug 2013, her 5yrs qualifying period will be in 25/08/2018. Her current T2 depend ant visa is valid until Sep 2018. My workplace and sponsor for current T2 visa does not change until Sep 2018.

If I get my ILR visa in thus Sept 2017, would my wife's current T2 dependent visa still be valid or does she have to change it once My current T2 visa changes to ILR?

1. You can apply this year, within 28 days of reaching 5 years residence on 25 September 2017 (you stated 1 Sept 2018 - unless you have typed the wrong dates/year). 2012 to 2018 is 6 years.

2. She can continue on her tier 2 dependent visa until she qualifies for ILR.

1. Yes, it was typing error, I meant I am planning to apply on 01/09/2017, 24 days before completing the 5 yrs qualifying period (25/09/2017 will be full 5years).

2. My current T2 visa and my wife's T2 dependent visa is valid until 18/09/2018. My workplace does not change until Sept 2018(sponsor for T2 visa).
If I change my T2 visa to ILR on 01/09/2017, can my wife still stay on her current T2 dependent visa and complete her 5yrs period on 22/08/2018 to apply for her ILR?
or Does she have to change her T2 dependent visa to PBS dependent visa at same time when I apply for ILR on 01/09/2017?

I would appreciate your advice to clarify it! Thank you!

Should be fine yes as long as you meet all the requirements, including salary.

She can continue on her current visa till she qualifies for ILR. Your being employed has nothing to do with her visa once you get ILR. She is dependent on YOU not your sponsor.

Yes, my salary meets the criteria, basic salary more than £35000.
