Hello,

I am an American married to a British person, with a spouse residence permit that expires 23/11/17. This is my SECOND 2 and a half year permit, so I assume I will be applying for IRL (but that is a different story).

My question is I have booked a flight to the states from 17/11/17 - 26/11/17, so clearly I need to get my residence permit sorted before then. How do I do this? Should I apply for premimium service? IS there a time limit that I can't apply too far in advance? If I apply too far in advance will this mess up my IRL?

You can apply 28 days before the expiry date on your current visa. If you apply too early you will have a shortfall in your qualifying period for ILR and will have to submit an additional FLR(M) application.

If you apply for SET(M) (ILR) at a Premium Service Centre for an additional fee of £590 (£2297 + £590) the decision is generally made on the same day and the BRP will arrive in the post within a few days. A postal application could take up to 3 months to process.

On what date did you enter the UK with your first spouse visa?
Char (CR001 not Casa)
