Good Afternoon to All Members,
I need advise in the following matter.
I applied for ILR on the basis of Tier-1 Entrepreneur Accelerated route of 3 Years. My wife & my daughter are dependant of me. My wife came in UK 3 Years ago so I applied for her FLR. I didn't apply for my daughter's visa. As she is dependant of me and got her visa previously which is expired now in last week (10 July 2017) same time as mine, and I was advised by solicitors that I have to wait until I get my ILR and then I have to apply for neutralisation for my daughter to become British Citizen.

My Concern:
What will be the status of my daughter now as I didn't apply for her Visa Extension?
God Forbid, If for any reason my application get refused and Home Office allow me further extension of 2 years instead of ILR, how I'll apply for my daughter's visa and Home Office will not consider her as an over stayer. My daughter is 2 years old.
Today when I visited my solicitor again and he advised me that I can apply for a dependant visa of my daughter for my peace of mind.

When did her visa expire ??

If her visa has expired more than 14 days ago and you did not apply for her extension, she becomes an overstayer and cannot apply within the UK any more if such scenario arises

Why didn't you apply PBS dependent extension foe your Spouse? There was no need to apply FLR. Which FLR dis you apply? FLR(M) or FLR(FP)?

is your daughter UK born?

I am very sorry as there was a typo error. I applied PBS Dependent for my wife.

is your daughter UK born?
Yes, She born in UK in October 2015. I got her first Visa in January 2016 which expired at the same time, when my visa expired but solicitor advised me that no need to apply for her as she will be entitled for british Citizenship if I get ILR. But I am worry if I don't get ILR and only get extension, what will happen?

Her Visa Expired 10 July 2017.

As I mentioned that solicitor advised that no need to apply and have to wait for ILR but in worst scenario, I don't know what will be her status? I still have time if it is 14 days period, Should I apply for her dependant visa ASAP?

My Solicitor applied for my wife PBS Tier-1 dependant, as my current visa status is Tier-1 Entrepreneur & I applied for ILR. She was on my dependant visa already which expire on 10 July 2017.

Which category she should apply for?

You said she applied FLR, which for immigration means the categories FLR(M) or FLR(FP). FLR is a spouse visa or a spouse visa outside the rules when you don't meet the income requirements.

If she applied for an extension, then the correct wording is PBS Dependent extension. This would avoid confusion.

Yes, I mentioned in previous messages that I applied for her PBS dependant visa not the FLR as mistakenly I typed here FLR. I am here to know about my daughter's visa and still waiting for the response from any prospective member.
