Changing Marital Status

Post by elClaudio » Thu Jul 20, 2017 5:04 pm

I'm currently in the UK on a Tier 5 Visa. Can I get married to a UK citizen under this visa? do I need to notify the Home Office of my change in marital status? when, before or after it changes?

And, will I need to change my visa after? or will I be able to remain for the length stipulated on my current visa?
I understand that if I want to remain in the UK after my visa expires I can apply for a "join a family member" visa, but the question is whether I have to change it straight away even if my current Tier 5 is valid for another 18 months.
Thanks!

Yes you can marry. You are required to give 28 days notice at an HO approved Registry office. They will notify HO of your intention and this notice period could be extended to 70 days for HO to investigate / interview both of you separately.

If your name does not change, then no need to update HO of change of circumstance and getting a new BRP card.

You can remain on your visa as long as it is valid and can switch within the UK to a spouse visa provided you meet all the requirements. Simply marrying does not invalidate your visa.
