Tier 2 ICT Cool Off Period

Post by sumitthapliyal » Thu Jul 20, 2017 6:55 pm

1. I am currently in Tier 2 ICT visa, my wife is working as my dependant in the UK in a UK based MNC.
2. If my wife gets her own Tier 2 ICT or Tier 2 General Visa and I become her dependant.
3. Then if I want to get my own Tier 2 General visa through a UK employer, do I still need to do 12 months of cool off period or will it not be applicable as I changed my visa to Tier 2 dependant from Tier 2 ICT.

Please let me know if you have the answer to this query.

Yes, possible. She has to apply from home country and the sponsor must complete the full and proper RLMT process to prove she is not 'pre selected'

Yes, 12 month cooling off still applies and the 12 months start from the you are granted a PBS dependent visa and you can then only apply for Tier 2 general from your home country exactly 12 months later.
