Is it ok to travel abroad if I am on T2d and spouse on ILR?

Post by Faar23 » Fri Jul 21, 2017 12:18 am

Hello, my husband is on tier 2 visa and will apply for his ILR on September 10, 2017. My daughter and I are on tier 2 dependant visa which is valid until August (maybe April, I don't know) 2018. I was wondering if I can travel to Canada from August to past September 10? We are not planning to apply for ILR dependant visa for myself and my daughter until next year before my visa expires.

Will that cause any issues at the UK border? That I have a different dependant visa than my sponsor?

Thanks

On what basis is your husband applying for ILR, tier 2 with 5 years residence or 10 years long residence?

5 year long residence.
Do you 5 years PBS?

There is no "5 year long residence" catergory.

Yes that one. Sorry I don't really know the nitty gritty definitions. All I know is that he is eligible to get his ILR after September 10, 2017 based on 5 years.

At the moment he is on tier 2 general visa.

You are free to travel as long as you have a valid visa. Make sure you return before your visa expires.

Okay. Just so I am clear. I don't have to be on ILR dependant visa to travel abroad, even if my husband has ILR. so long as I have a valid visa. Because he spoke with a lawyer and that guy said that I have to be on the ILR dependant visa too because I am his dependant thus we need to have same visas. If I am not then they will give me a warning the first time coming from abroad and will send me back to my homeland next time if I am coming from abroad. Is that true?

I don't want to be rude, but if I may ask are you a qualified person to be giving this advice. I tried clicking on your name, but I am on mobile and can't seem to. Again not trying to be rude and I really hope you dont take any offence by it. Just want to tell my husband that someone qualified said it's ok to travel abroad.

The requirement to switch to ILR dependent is ONLY applicable if your spouse got ILR based on long residence.

The rules permit you to stay on your current visa till you qualify for ILR, if the main PBS migrant got ilr thrpugh the PBS route, link to the rules below.

So the solicitor is wrong. Hope they didn't charge for such poor advice.
