Dependent UK Visa for 70 year old woman

Dependent UK Visa for 70 year old woman

Hi,

I am a British Citizen and my mother is a Mauritian Citizen. She is 70 years old. As a Mauritian Citizen she is entitled to Visa on arrival in the UK. She used to live in the UK and was granted an ILR in 1971. i was born to her in 1983 and she moved to India (My father had ILR) and lived in INDIA permanently till 2015. She travelled once to UK in 2011 and went back in a week. I moved back to the UK in 2016 and before that (in 2014) applied for her Returning Resident Visa from INDIA for her to come and stay with me. Her Visa application was refused.

When i moved to the UK in 2016, we decided that she can come and visit me for 3 months and i can go and visit her accordingly in INDIA and keep in touch as i am her only relative alive. She came to visit me in Dec 2016, but was detained at the airport for 8 hours as they suspected that she would not leave the UK. Anyways after her 8 hour ordeal, she was denied entry but under exceptional circumstances she was granted temp visa to visit me for 2 weeks only. Her passport was confiscated and her tickets were booked for after 2 weeks to leave the UK.

I am pursuing legal options and have consulted a lawyer and put in an application for her to stay with me as she has no one in INDIA aur Mauritius and has no one to look after her. My Lawyer seems confident that things will take a positive turn but i guess no lawyer will be a bearer of bad news initially.

Also, While her application is being reviewed, she has been asked to report to the reporting center for some time.

My questions are:

1) Can the Home Office detain a 70 year old woman during reporting?
2) What are her options in terms of the case? If i am ready to foot her medical expenses, will she be allowed to live with me?


Apologies in advance, if my question is repetitive in any sense with regards to this forum. I was just concerned and hence posted my questions.

1. Yes

2. Not a lot, no.

UK immigration rules do not permit chain migration, your options are;

1. Move back with her

2. Try EU SS route, will take a long time, Brexit may foul it up, big life change.

3. Pay for a carer for her back home

Have a read through the links below. This is the toughest visa to get and virtually no chance of success, very few have been successful and the handful that have, was after very long and expensive court cases

Thanks so much, but as mother has no one in Mauritius and INDIA, wont this be considered under Human Rights?
