Swapping Employers under TIER 2 shortage occupation

Post by Bonnie Doon » Wed Jul 05, 2017 10:44 am

Hi,

Hopefully someone out there can help me out.

Im currently on a Tier 2 Shortage occupation visa (Coming up to expiry this September - my wife and daughter as dependents under my visa also).

I am currently employed by a company that hires my services out, hence i am a contractor. The company that i currently do all my contract work for (not my actual sponsor) will not change however they are offering me a permanent position directly so i will need to swap sponsors. It is the same role or better if that detail matters.

My questions is

Can I extend my visa through this contract house and then swap sponsors at a later date at no cost or am i best to get my COS with my new sponsor and apply before visa expiry that way?

Thanks in advance!

Contracting on tier 2 general is not permitted and is illegal.

It is a breach if your visa conditions.

What is the set up regarding your salary payments from this contracting house?

Do they charge you a monthly fee/commission?

How did you get the contract at the company you are currently contracting at?

If you want to work for the other place where you are "contracting", then you will have to apply for a new visa with a valid COS, assuming they are an approved sponsor.

Thanks CR001,

So if say i extended with my current employer, would i need to re-apply / pay the full fee once again to swap over to my new employer?

Yes, in addition to the health surcharge.

Tier 2 General is not transferable between sponsors, a new application and COS is required each time.

Swapping TIER 2 sponsors

Post by Bonnie Doon » Thu Jul 20, 2017 5:33 pm

Quick one guys, hopefully some of you can help.

Extending my TIER 2 (shortage occ) visa incurs a fee for the visa application as well as the NHS fee.

If i was to swap employers after visa extension, would would i need to pay the NHS fee again? (I realize id need to pay for another tier 2 application).

Yes you will. You have to pay the IHS with every application you make.

Swapping Sponsors

Post by Bonnie Doon » Wed Jul 26, 2017 1:03 pm

Hi again,

So ive just been offered another job on a Tier 2 Shortage occupation visa with another company. Thing is my current one runs out on Sept 3rd 2017(which i was in the process of extending).

Question is: what is the minimum time i need to swap employers before my Visa expires? I know its a 6 -8 week turn around on extending with the existing sponsor.

Many thanks!
