Hi Everyone
I came into UK via visiting visa, I met my husband who was an old friend and who is an eea national and got pregnant in September because I was married to another man then I could not marry him but rather wait for my divorce. I over stayed my visa for 8 month. My husband applied for my RC and now I have my permanent resident.
After 3years of my PR I decided to apply for BC but the problem is that I did not declare to the NCS that I overstayed my visa. Although I did not work because of my visa and my husband was self sufficient.
What do I do.? Write a letter to home office. I spoke to a lawyer who said has long as I did not work but I don't want home office to see me as a liar i am a student nurse and integrity is very important.

You don't state the date you came on a visitor visa or the date you married your partner.

You will likely be refused citizenship due to the period of overstay from August 2008 to April 2009.

Did you declare your overstay in your application form and the date you first entered the UK as a visitor? If not, this is withholding important information.

An application will likely only be successful after April 2019, 10 years from the date your status became legal due to marriage to an EU citizen.

Makes no difference. You were an overstayer from the date your visit visa expired. You also were not entitled to free NHS.

To say what exactly?

You will likely fail the good character requirement due to being in the UK illegally between August 2008 and April 2009. Simply living with an EU citizen doesn't give you any rights.

You must make the HO aware of this asap otherwise this maybe seen as deception attracting a ban of 10yrs from the date of application. You may also consider withdrawing your application altogether if you have applied recently. Seniors can advice better.

No. A request for biometrics is only the first stage in processing the application.

It seems to me you've been given very good advice already. I'm not clear on what more you need.

Since your application is very likely to be rejected, you aren't getting the fee back either way. If you withdraw it, then at least you will definitely avoid being banned from reapplying until 2027, as Coldwinter, pointed out.

I realise you were hoping that someone could advise you of a way to make your application valid and likely to be approved, but your circumstances indicate that you have applied for naturalisation before you fulfilled all of the requirements for it. The only thing we can advise you to do is to withdraw or amend your application so that you avoid being found to have used deception on it, and to wait until you do fulfil all the requirements for citizenship before re-applying.

Thanks for the advice, I was actually qualified I had my five years resident permit and my permanent resident for 3years and four month now. The only issue was my overstayer.
