Query on Tier2+Tier2 Dependent for ILR

Post by wanderingvas » Sun Jul 30, 2017 12:42 pm

Hi All,

I have a question on my ILR eligibility.

I was under Tier2 ICT (from 2011 - 2014). Married in 2014 and my wife has got job and she is under Tier2 General Visa. I then became her dependent (Tier2 dependent from 2014-2017). Now my wife wants to discontinue her job for personal reasons. If i switch to Tier2 General now (2017), will my Tier2 dependent period (from 2014-2017) add up for my 5 year ILR period?

myself:
Tier2 ICT - 2011 -> 2014 (3 years)
Tier2 General Dependent - 2014 ->2017 (3 years)
if i switch to Tier2 General now (i.e., from 2017 to 2020 for 3 years)

will i be eligible for ILR?

Also for my wife:
Tier2 General - 2014 - 2017 (3 years)
If she switch to Tier2 General Dependent now (i.e., from 2017 to 2020 for 3 years)

will she be eligible for ILR?

which is the best option in our case for ILR? kindly advise. Thanks.

You cannot combine PBS main visa holder time with PBS Dependent visa time. You need 5 years as PBS Dep or 5 years as Tier 2 General main visa holder. Combining time can ONLY be used for ILR based on 10 years long residence. You cannot 'switch' within the UK to Tier 2 General, you must apply from home country after the full and proper RLMT process has been completed before you are offered the job.

No

See my first comment. You cannot combine different visa categories to make up 5 years for ILR.
Char (CR001 not Casa)
