Enterpreneur Spouse Dependants (Stepsons)

Dear All

Would you please advise regarding this case

My wife is applying for Tier 1 Entrepreneur Visa (50K). She has no children but I have two sons from my first marrige.

I understand that once she is granted the Visa, I will apply as a dependant but about my two sons. Are they eligible for a depandant/children visa as well.

Should we wait till she is grnated the Visa or should we apply with her since the begining?

Where is their mother?

How old are the children?

Do you have official evidence of sole responsibility?

The kids are 9 & 12 years old

Their mother is living in home country with them.. same place I live

She us willing to have them up to live permenantly with me

Last question please..Does it make a difference if we switched and I applied for the entrepreneur visa.. Are my kids eligible this way as dependable even if I'm divorced from their mother?

The children will only be granted a dependent visa if you are able to show and prove you have sole responsibility. See link below.

Without evidence of sole responsibility, the children won't get a visa, regardless of you being the main Tier 1 Ent holder or your current wife.

Thanks Alot CR001 for the explanation.

So I will work on the custody papers before issuing an entrepreneur application and I guess either myself or my current wife as main applicant would not make any difference then to the children case.
