SET(O) Queries-Dependants applying separately

Hello immigration experts,

I have explored the existing threads related to dependants applying ILR separately but not able to find answers for all my questions. Apologies if I repeated any questions which was already answered in the forum.

My wife has got British Passport about 2 years back. I and our 2 children were applied for PBS dependant’s extension about a month back and completed biometrics last week.

I & children are getting eligibility for ILR in about a week and we are in the process of varying our PBS extension application to ILR.

While filling the SET(O) form, getting confused in many sections :? I have listed out all my queries below which may be little lengthy but almost all of them required YES or NO type answers hence won’t take much time for experts.

Payment Details:
As per my understanding, since we already paid fees for PBS extension which is in excess of ILR fees no need to fill the payment details.
Do I need to tick main applicant+ 2 dependants £ 6891 box under item 5 of payment details page?

Section 1: Applicant Details
Do I need to mention my details here or the main applicant (my wife) details?
Section 2: Dependants who are also applying
a. Is it OK to enter the details of my 2 children (under 16) in this section or do we need to fill separate applications for each dependant?
b. Partner details from 2.1-2.7 Do I need to fill my wife’s details in these sections?

Section 3: Which Category?

Here, I have to tick “Tier 1 Dependant”. Please correct me if I am wrong.

Section 4: Knowledge of language and life in the UK

Question 4.2: Is your partner is applying with you, is he or she aged 18-64?
Since my spouse is already a British Citizen, which option I should choose here?

I have my LIUK certificate & NARIC certificate for English knowledge

Section 5: Your home and finances

a. 5.3 Are you working in the UK?
Though I am working as a contractor, do I need to say ‘Yes’ & fill in my salary here?

(Since my wife is a permanent employee, it would be straight forward to get payslips, employee letter etc)

b. 5.6 Filling details of income source

Should I mention my salary details here? I can fill my wife’s salary details since she has all required documents

Section 6: Immigration History

It asks the details of main applicant which means me or my wife?
Should I fill details about my absences from UK? ( it is less than 125 days in the past 5 years)

Section 7: Personal History
7.13 How long have you lived in the UK?
Since I am living in UK since 2009 with Tier 2 ICT but moved a PBS dependant of my wife in 2012. Should I consider years only since I moved as PBS Dependant?

Section 8: Photographs
Since already I sent 2 photos for PBS dependant extension, do I need to attach photos again for ILR?

Section 9: Tier 1 Points scoring assessment

I guess we can skip this section

You need to complete the form, write a covering letter that you are varying etc. PBS Extension fee is LESS than ILR fee so you will have to pay the difference OR pay the ILR fee and get a refund of the PBS Dependent fee. IHS fee (£1800 for 3 applicants) is NOT part of the PBS dependent fee and will likely be refunded if ILR is successful.

YOU are the main applicant not your spouse who has BC.
a. Yes. One form for all three of you.
b. Yes

If that is the category you are under then yes.

Tick no for your spouse. You are the main applicant so answer the question for you only.

You are the applicant. You can complete both sets of details if the form has space for it.

YOU are the main applicant. Yes to absences.

You need to send photos again. It is a separate and different application and goes to a different department.

Appreciate your swift response CR001..

Please clarify the below queries.

Payment Details:
If we exclude the IHS for 3 applicants still I have to pay £1473.00 (3*2297 - 3* 1806). So we have to fill the payment details section and pay the difference fees of £1473.00. Am I correct?

I can write a detailed covering letter explaining all these

Section 5: Your home and finances

If I mention my details, what kind of documents I need to submit as part of this finance? Payslips & Bank statements would be sufficient or should I also produce the dividend statements from my accountant?

Section 6: Immigration History

a. What sort of evidences I have to submit for my absences from UK ? I can submit air tickets copies but as a contractor I may not able to get any letter from employers

b. "6.1 When did you (the main applicant) first enter the UK? This refers to the date of your first entry into UK at the beginning of the period of stay on which this application is based."

Does this mean, I have to fill in my entry date after I switched as a PBS dependant to my wife in 2012?

Section 7: Personal History

7.13 They asked "How long have you lived in the UK?" and followed by question which is asking periods of absence of more than 6 months. I think this is calculated from the date when I entered UK as a PBS dependant. Please advise.

Hi ELANILR2017,

Hope you managed to get the ILR. I am applying ILR for my wife who is also a contractor and I got the ILR few years ago. Would you be able to confirm what documents did you submit for section 5 of form set (O) please?
