Urgent : Retention residence

Hi

I have been married for four years and my baby was born last month. I am married to a British citizen and I am currently on FLR (M). My partner behaviour is not good to me and my parents. I am deciding to Apply for divorce but our marriage happened abroad and we did not register here.
Please can you tell me how I apply for extension here and apply for divorce here. What are my chances for PR later and how long I will have to wait for PR. Do I need my baby passport for retention application.

Doesn't matter where you marriage is registered, you can still apply for a divorce here as long as you follow the property process and fall within one if the 5 categories of reasons for divorce.

Suggest contact Citizens Advice for divorce advice as this is not the correct forum.

You cannot apply for an extension of your spouse visa.

You will have to apply for FLR(FP) PARENT route once you are separated and living away from your partner.

Thanks for your guidance.

Do I need child custody and child passport for FLR(FP). As my child is very young, it is unlikely that I will be working soon. Can I stay with a friend and use their statements to prove that I can stay here.

I would appreciate guidance on my previous queries. Also do I still qualify if divorce is settled outside UK (I read eligibility retention residence on Gov.uk website) that divorce must be made in UK.

Retention of Residence DOES NOT apply if you are on a spouse visa. It is only applicable to spouses of EU citizens (non British).

Friend is fine. If you are the mother, FLR(FP) parent route is the only option you have.
