Flr(FP) same day decision. Anybody done it recently?

FLR (m) or FLR (fp)? Please help!

Hi everyone. My first time posting on here although been lurking for a good few years!

So myself and (Egyptian) husband did SS route. Got family permit first time from Ireland and been bk in UK since June 2015. Our son was born here in august 2015. Residency card was refused in April 2016 for ridiculously stupid reasons. As of yet we still have not had a court date for appeal and now my father in law is quite sick and my husband has to complete his army papers, in egypt, in sept. We have managed to claw together the money to do the 5yr, same day decision, route. I am exempt from the financial requirement as I am in receipt of carers allowance for my mum.

I was recently told we can only do the 10yr route, as the parent of a British child, as we are ineligible for the 5yr because we entered here under Eu law, not domestic.

Can anyone help please?

Is it a pretty (or relatively at least!) straight forward application?

Would ppl recommend getting our lawyer to put everything together or is it something that can be done alone (in your opinions!).

A much more straight-forward option would be for your husband to apply for entry clearance as a spouse when he goes to Egypt in September. I would not recommend an in-person appointment as your case does not appear straight-forward.

FLR(fp) would be a postal application for you, because again, your case does not appear straight-forward.

Thanks for your reply jutbhe won't be going at all unless we have visa already. Not going to risk it being refused and us being separated. Atm he is legally here but if he leaves he won't be allowed to re-enter.

I know if people that have applied for the 5yr route but have confused myself with the 2 options because they are both either 5 or 10 year! Wasn't sure which one we can go for!

I'm obviously more out of touch than I thought.
I thought the main difference between 5 and 10yr was due to the inability to meet the financial requirement for 5yrs

Due to the fact that there is no FLR(FP) 5 year Partner route. As has already been mentioned, your husband doesn't qualify for the Parent 5 or 10 year route as you are living together.

The 10 years route is not for people who cannot meet the financial requirement only . It also applies to, amongst others, those who don't meet the immigration status requirement. A category your husband falls into.

OK, thanks for your help. One more question. If we decide to wait for the appeal date to come through (16mths and waiting!) Is there any sort of compassionate 'leave' we can apply for to allow him to go back for a few wks but regain entry?

Decided we going to go for the same day decision as hubby needs to get home asap and still awaiting court appeal date.
Has anyone done, and been granted the same day decision? Do you get the card there and then? Any tips.

There is no guarantee that any visa application will be granted using same day service. In person should not be used for complex cases, which his appears to be.

No the card is not issued and given to the applicant on the day. It takes 7-10 days to be delivered, sometimes longer.

He would have to withdraw his appeal and then apply.

Then go ahead and apply. Unlikely he will get a same day decision.

As has already been advised, the simplest way would be to apply for a spouse visa from Egypt.

And how would we live? He works, I'm full time carer for my mum and our toddler. We just renewed our Tenancy.
Us being separated isn't an option. We either stay here together or we leave together. We've never been apart and he won't be away from his son. That may work for other ppl, but it not a situation we would put ourselves in to on the HOPE that his visa would be approved
