Can my employer increase my working hours?

Post by Wab13 » Sat Aug 05, 2017 2:12 pm

Hello all,

Sorry if this has already been covered.

My original sponsor visa was set at 42 hours when approved, my boss now wants, only me of all employees, to increase my working hours substantially. The business is expanding and this is not due to a general downturn.

Can he do this? What are my rights here?

Worse case scenario, I am in a long term relationship with a British Citizen. If I was to apply for a non married spousal visa, what tier category is this? Has anyone in here been in a similar scenario?

How much is 'substantially'? If you are the only one in the company who will have increased hours, this may well raise HO suspicions and a suspension of th sponsor license while HO investigates.

This isn't a 'tier' category. If you have been in a relationship 'akin to marriage' for at least two years and have substantial evidence of living together, then you could apply for an unmarried partner visa on form FLR(M), provided you meet all the requirements. This will reset your clock towards ILR to zero and a new 5 year route to ILR (2 x 2.5 year visas).

Do you mean increase as you've written, or 'decrease' (reduce). :?:

Hello,

Thanks for the replies!

I do mean to increase my hours, by between 5 - 10 extra hours a week, on the same salary. The business will be expanding and I suspect he feels the pressure of the additional aspect of the business not earning in the short term.
Surely this needs to be a formal conversation?

How much does an unmarried visa cost? Is it possible to switch to this, and within the Uk?

It does and it will need to be reported to HO on SMS system too which might trigger an investigation.

Yes you can switch within the UK as I have already stated, provided you have rock solid evidence of two years cohabitation (no discretion for this) and meet all the requirements. Cost is £993 by post or £1,583 for in person same day decision at premium centre. You will also have to pay £500 immigration health surcharge.

Unmarried partner visa questions should be posted in the sub forum linked below please.

Thankyou! So if, say, it wasn't reported on SMS, what can happen?

And if it's reported and an investigation happens and they lose the licence, would I in turn lose my sponsorship/ job!?

Your sponsor has certain rules and obligations that they must follow. Not doing so can cause the suspension of their sponsorship.

Yes, they cannot sponsor you if they don't have a licence.
