is Surrender Singh possible route for failed asylum seeker

Post by scorpio1978 » Sat Aug 05, 2017 4:22 pm

Hi I am a UK citizen living in Scotland -My fiance is Iraqi national and failed asylum seeker. We were wondering if I moved to Dublin under the rules for Surrender Singh, would he be able to join me. He does not have LTR in UK or any kind of visa for the UK. Home office know he is till living in UK with me. Would he be prevented entry to Ireland? He left his country because it was too dangerous for him to stay there and is very worried he will be asked to return there and submit his application from there. Any advice would be appreciated . Thank you ! Aisha

If you are intending to return to the UK together after a period in Ireland exercising your Treaty rights, you should be aware that your husband's EEA permit is likely to refused due to an intention to 'circumventing the UK Immigration Rules'.

I am just looking for other options. My salary doesn't meet the £18600 per annum unless I get a 3rd part time job for a 6 month period. We are not married yet and have no children. We are not sure if we can even get married in the UK with his immigration status. Just need some advice. Have no idea what we can do to be honest. I just heard about the surrender singh route from a friend and heard it has worked for other people.

We have known eachother for a while now. He was living in London but now lives with me in Scotland. We really want to get married and have a family but right now it seems impossible because of these immigration rules . I have updated some utility bills to have both of our names. I own my own flat so moving to Ireland would be no problem as I can rent it out.

Unlikely you will qualify for a route visa any other EU country as they have requirements to be met as 'durable partners', usually at least 1 year cohabitating but most are 2 years cohabitating in a durable relationship.
