Dear Gurus ,
Can I apply within 14 days of the AR decision for depended application ?
However if I applied TIER 2 depended within 14 days then I can vary FLR ( M) if TIER 2 dep not finalised at PEO ??
Technically TIER 2 dep will be within the 14 days of overstay , but FLR( M) will be beyond ( lets say 30 days) but before the out of time TIER 2 dep decided ??
Please its very urgent ... Gurus get back

You can vary an application only if it is undecided. If it is refused then you cannot vary it

Please answer the followings
Technically TIER 2 dep will be within the 14 days of overstay

As I said, you can vary a valid but undecided application at anytime. This has nothing to do with when your section 3C ended, given that the very first application was submitted within 14 days of section 3C coming to an end.
Varying a postal application at PSC will not lead to a same day decision as your documents must be requested to be sent to a PSC

Sorry i did not get it
Lets say I apply TIER 2 on 22/07/2017 but not decided ( within 14 days of the AR refusal on 12/07/2017 )
But if I apply FLR ( M) on 01/08/2017 via PEO then my FLR (M) is valid ??

I do not understand why you are so confused. It is really simple.
Tier 2 application applied within 14 days will be VALID. You can then vary this pending application (Tier 2) to FLR(M) at
anytime as long as your Tier 2 application is pending and UNDECIDED.
The real question is why not apply for FLR(M) from the start ????!! Why are you even considering this ??

To make it simple, read the guidelines on variation.
Date of application: application to vary
Where an application is varied, the application date remains the date of the original application.
So, if you vary your applications 60 days later (for example), as long it was varied when it was undecided, it will take the date of the original application.

If your spouse is apply for ILR on the basis of 10 years, you should apply for FLR(M) at the same time with them. No need for variation

You can remain and extend as a PBS dependant until eligible for ILR as he is applying under 5 year settlement
Apply for a PBS dependant extension at the same time as his ILR. You absolutely do not need to apply for an FLR(M)

10.12 Have you or any dependants who are applying with you ever engaged in any other
activities which might indicate that you may not be considered to be persons of good character?
So If say NO and then
Can I explain I have refused under 322 -5 in the additional box ???
I also notify everything in the AR

This is becoming confusing. What happened to your spouse's ILR ?? Why are you saying your ILR ?? Why are you going down the FLR(M) route ???
