Visitor status with visa curtailment

Post by readyplayerone » Mon Aug 07, 2017 10:11 am

Hi all,

Searched for an answer to this, but without luck. If there's a pre-existing topic on this that I missed, please direct me to it.

I had a Tier 2 visa, but left my job last December. I notified the Home Office and thought that my visa would automatically be cancelled when I left my old employer.

However, I only received an letter the other month informing my that my visa will be curtailed this September (so 9+ months after I left my job).

I'm in the UK at the moment as a visitor (as a Canadian, I can spend max. 6 months here out of 12). The border officer gave me 6 months entry.

What I'm not clear about is whether my current time (up until the curtailment date in September) counts towards my 6 months in the UK. Or does the visitor stamp in my passport overrule that?

I'd really like to know if I've got more months than I thought (of those 6 allowed months out of 12), if I want to visit again next year.

Thanks!

you are in uk as a visitor. It doesnt matter what the letter says, u legally dont have right to work, and can only stay for 6 months since u entered as a visitor.

Hey,

I'm not looking to work. What I want to know is if the time up until my existing visa is curtailed counts towards my 6 months as a visitor in the UK.

Eg. I arrived in the UK 1 June. As a visitor, I can stay until 1 December (6 months). Then I will have to leave the UK for a further 6 months (total time since first visit: 12 months) before I can enter again.

However, if my Tier 2 visa isn't curtailed until 1 September, does that mean only 3 months (1 Sept - 1 Dec) count towards my total of 6 months out of 12?

i cant make much what the exact question is from your reply.
If you are talking about the cooling off period, it kicked in on the day u left the uk. You entering the uk again on visit visa has nothing to do with it.

I'll try again :)

I would like to know if the period from when I entered the UK this latest time to when my visa is curtailed (about 2 months) is counted in my 6 months of time (out of every 12) I'm allowed to stay in the UK as a visitor.

Or does my 6 months only kick in once my visa curtailment date occurs?

Essentially, am I technically a visitor right now? Or since I've been let back into the UK (I've been outside it since I left my job last year), am I here under the conditions of the visa (eg right to enter)? I still have my BRP.

You are here as a visitor and have been admitted to the UK and stamped in as such. Your 6 months starts from the last date you entered the UK.

No, you 6 month clock has already started when you were admitted as a visitor.
