Query on Tier 2 G Extension

Hi All,

Hope everybody doing great. I presume this question was asked so many times, but I am trying to answer my own questions here. If you can confirm the same or correct me if I am wrong please, i will be really grateful to you.

My Visa is expiring by mid of Jan, 2018, but planning to apply within this month or beginning of next month. My queries as follows :

1. I presume my employer can issue my COS with start date from december, 2017 instead of Jan, 2018 that's when it's actually expiring? Please confirm.

2. I think we can apply for visa maximum 3 months before the start date of the COS. So, If I am applying by 1st of September, 2017, my COS start date should be within 1st of December, 2017 ? Please confirm.

3. Tier 2 G Extension (with same employer) :
a) No RLMT required - (I presume Yes).
b) My employer can write as follows for details of RLMT ->
Give details of the resident labour market test...:
This role has been previously advertised and this application is an extension to his current contract.

4. Documents required to submit :
a). Passports.
b). Photo.
c). BRP

5. Additional docs, but not mandatory -
a). Payslips.
b). employer letter
c). bank statement.

6. No maintenance required for extension.
7. Separate applications for dependents.
8. Dependent will submit the same documents as mentioned in No. 4.

Hello,

When you fill in your extension application online, you have the option to add dependents (spouse / child). Total fees will be calculated accordingly (1 Main applicant + 1 Dependent) etc. In this case, you don't have to submit any extra document. Just BRP, passport & photos (main applicant + dependents) with application form.

@sk17aaa, I presume adding your dependants to your application if you and dependants are applying at the same time.

From the gov.uk link too, it says your dependants need to submit a separate application. Correct me if I am wrong please ?

6. Extend your visa

You may be able to apply to extend your stay in the UK under a Tier 2 (General) visa.

You should include any dependants who are on your current visa on your application to extend. This includes children who have turned 18 during your stay. They’ll also need to submit a separate application.

@moonlight and others,
Today my HR was trying to assign a COS to me, but she could not proceed due to some doubts. She has already emailed to Home Office mentioning her queries.

She can see in SMS that while assigning COS, it is asking her to select category or sub-category something like "ISC-liable" or "ISC-exempt". She did not assign as she was not sure of this.
I presume ISC is Immigration Skill charge and as mine is Tier 2 G Extension, it will be "ISC-exempt". please confirm.

Another question on English language requirement:
In Tier 2 Guidelines, it says :
Previous grants of leave
162. You will be awarded 10 points for English language where you have met the English language requirement in a previous grant of leave. This will be the case if you have ever been granted leave :
under the Tier 2 (General) category under the rules in place on or after 6 April 2011, having provided evidence of having a knowledge of English equivalent to level B1 of the Council of Europe’s Common European Framework for Language Learning or above;
-> When I applied for my Visa, I submitted my degree certificate which confirms I was taught in english. My question is does it confirm that it's equivalent to level B1 of Council of Europe's Common European Framework for Language Learning or above . Please confirm.

Hi ravisb_2014,

Visit the link "submit a separate application",

Scroll down to "Dependants applying in the UK on their own" and click on Partner / Child.

It says "You should use this service if you are applying after the main applicant has already submitted their application or been granted leave in one of these categories."

I made an extension application 30th June (Myself + wife + child).
Filled in my details, then added my wife and son as dependents
Paid NHS surcharge (for all 3 applicant)
Paid the application fees for all 3 application online
Got the biometric letter after 5 days (for all 3 applicant)

Provided your initial Tier 2 visa was granted before 6th Apr 2017 (which I think is the case), you are exempt of ISC while extension.

Not sure on your other query about language requirement. My understanding is that you need not prove it since you have already done it in the initial visa application. Not sure on the clause though.

Hi ravisb_2014,

Sorry cudn't reply earlier.

Since you are already on a Tier 2 Visa / Extension, you dont have to provide proof on English language requirement or Fund Maintenance.

Once you fill in your application online, it will give you a list of documents to submit along with the application.

Ideally
1) Passport (Main applicant + Dependents, if any)
2) Photographs(Main applicant + Dependents, if any)
3) Biometric(Main applicant + Dependents, if any)

1. In CoS, 'Give details of RLMT including where and when the post was advertised and reference number(s) for mandatory advertising:' -
Our HR has put 'This role has been previously advertised and this application is an extension to his current contract'.

Note : It's an extension to the same role as earlier - SOC Code 2136.
Is the above statement liaise with the guideline?

2. In new application (started from september, 2017 i presume), It is asking to enter "Do you have a valid national identity card?"
-- Is it the 'Aadhaar Card' for candidate from India (whoever has applied recently and from India please comment) ?

3. My current Visa is expiring after 19th Jan, 2018 and my HR has mentioned the start date on CoS (extension) from 1st January, 2018.
-- Is that alright ? I presume i can only apply on or after 1st October, 2017 ?

4. While filling the application for me, wife and children, it only asked information of the Current passport. I have filled the form with the current passport details and submitting this Passport with the application.
-- Do I need to submit previous passports of mine, wife and children ?

5. In the online application, it does not ask for NHS surcharge details ?
-- I have not paid the surcharge yet, but wanted to know where do i need to enter the reference number once it is being paid ?

6. In Documents Page, it lists the list of Mandatory documents.
-- Can I submit only those documents and no need to submit extra document ?

Thank you very much CR0001 for clarifying this. I really appreciate that and support the same.
I always put forward my queries here so that it will be helpful for others. I did that earlier too and thanks to everyone for their help. I really appreciate everyone in this group who helped me answering most of the queries earlier.I saved money spending on solicitors and more than money, going to wrong direction as suggested by some of the solicitors.

The reason I tried to message sky17aaa is because he was answering my queries in this post and as he has recently completed his application, I posted some more queries addressing to him as I am filling my application too. As I was not getting response from him, so wanted to send him a message that "can you look at this post and reply please".

It looks fine. In mycase, my HR mentioned : "Not applicable as this is an extension of our sponsorship. <<APPLICANT NAME>> is an existing employee and has been working since <<YEAR>>"

I'm not sure about this question. Gurus can help here...

Is 01-Jan-2018 is your work starting date?

I did submit previous passport(s) for my wife & son, since their previous stamping is a Vignette in Passport not BRP. Better to submit, just to be on the safer side.

Fill in your Tier 2 application details first.
Then Register and Pay your NHS Surcharge thru https://www.immigration-health-surcharg ... ment/start (for you + any dependant(s))
Login / Go back to your Tier 2 Application. Confirm / accept the declaration (you wont be able to make changes to the application, after this stage). At this stage you will enter your NHS payment reference number manually in a text box and then pay your Tier 2 application Fees



6. In Documents Page, it lists the list of Mandatory documents.
-- Can I submit only those documents and no need to submit extra document ?

Since this is an extension all it needs is
1) Passport (Main applicant + Dependents, if any)
2) Photographs(Main applicant + Dependents, if any)
3) Biometric(Main applicant + Dependents, if any)

That's all I submitted.

3. Yes, 01-Jan-2018 is my work starting date.
My Previous Visa is expiring after 19th Jan, 2018 and My New CoS start date is prior to the expiring date of my previous Visa.
My question is - Does Work start date of my extension CoS need to be after 19th Jan, 2018 ?

You work start date is fine. Same in my case as well. My start date in COS was earlier than then actual visa expiry date. Regarding the total duration, Home Office will adjust your Visa to have maximum 6 years. So dont worry.


NHS Surcharge : since you have decided to make / submit your Tier 2 application, I would advise you to pay NHS surcharge first, so you have the reference number (you will receive an email once you have paid NHS Surcharge) in hand to enter and proceed with your Tier 2 application.
