Tier 2 general visa processing started. Confused

Dear experts

I got a new job in Bristol UK. Right now I am working outside UK. New employer is processing Tier2 general visa. They informed me that restricted COS is submitted to Home office and the main COS will be processed after that. What does it mean? I have to join the new Company by October 24th.

The company, if an HO approved sponsor, issues a CoS to you, then YOU have to apply for the visa and pay the fees and IHS fee.

This new employer is given the visa processing to a third party. I am in touch with them. I got informed that I dont need to pay anything for visa processing. The only thing I am concerned is what is restricted CoS, what is employer CoS etc. I am also worried, do I need to wait for full visa processing

Are you sure that this is a genuine job and not an umbrella company?

Have you been asked to pay for a CoS?

You have to apply in your home country and submit the documents and your biometrics yourself for the visa.

There is only ONE type of CoS for applications outside the UK and that is a restricted CoS.

Has this employer completed the full and proper RLMT process?

How did you find the job and what was the selection process?

There are 3 actors here
a) Me
b) Employer
c) The third party visa processing agent

The company is a famous pharmaceutical company. They did the interview online. After 3 technical rounds, I passed the HR round also. And got informed that I have selected.The employer outsourced the visa processing to a third party. They informed me that the restricted COS has been submitted to the Home office. I wonder what is the need for that? So home office will decide whether I am eligible or NOT? Am I in a safe position to put resignation letter in my current company?

Not sure why you are not asking the visa agent these questions.
They informed me that the restricted COS has been submitted to the Home office. I wonder what is the need for that?
You cannot apply for a visa until the restricted CoS has been issued to you. Applying for the visa without this will result in a refusal.
So home office will decide whether I am eligible or NOT?
If you meet the points requirement including the English one and the RLMT has been completed properly, then no reason you should be refused.
Am I in a safe position to put resignation letter in my current company?
I would strongly suggest you wait until your visa has been approved and granted before you resign.

I am copying the email sentences from their email.

"We have requested a restricted COS for you as you will be applying from outside the UK". It means, they applied it to me.

Also, I got the interview after they put it in the UK labor market, I think. I am having Pharmaceutical masters degree. I will do as you suggested anyway. I will wait for the visa to be processed. But the problem is my current company is having some rules for the notice period.

All this means is they have applied for the Certificate of Sponsorship. It is not the same thing as applying for the visa. You have to do that yourself and submit your biometrics in your home country.

Your current employer notice period is something completely separate to applying for a Tier 2 General visa.

If you resign before you apply for a visa and your visa is refused, you will then be unemployed.

To go for biometric, I need COS. So wait for that. So I will wait for the restricted CoS from home office or CoS from the employer. Feeling crazy.

1. Employer will get a CoS.

2. Employer 'assigns' CoS to you and provides you with the details.

3. YOU apply online for the Tier 2 General visa based on the CoS duration.

4. YOU attend your appointment at VFS (or similar) to submit your documents/application and enroll your biometric information.

5. Application gets sent to UKVI for processing.

6. You wait.

7. You get informed by email when your passport is ready to be collected at VFS (or similar).

8. You collect passport and only then find out if your visa has been granted.

9. Visa in your passport is ONLY valid for 30 days and you must travel to the UK within the 30 days and collect your residence permit from the nominated Post Office within 10 days of landing in the UK.

I am in a deadlock then!

my notice period is 3 months. Visa duration is 30 days. So I need to take a risk to put resign letter before visa to be ready. Allah, what an experiment is this....! I will ask for the HR of new employer to handle this.

You can ask HO to post date your Tier 2 General by up to 3 months in advance.
