ILR for dependant more then 18 years

Hello everyone,

Could someone clarify for me about dependant status after 18 years?

I'm on Tier 2 and in the end of 2018 I'm going to apply for ILR. My son is on dependant visa and he turns 18 just before application. He studies in school now. Can he apply for ILR as dependant in that case? What may be other options?

What are the dates he has been in the UK from the first time he came?

Does he have 5 years residence, English B1 and LIUK??

If he is wholly dependent on you and not leading an independent life (working, living on own), then yes he can apply. He must apply on his own Set(O) form.

He will have 5 years residence to moment of application, he passed GCSE, which should be enough as English B1, and we will pass LIUK of course. He will be on second year of A-level in school and live with us, so yes, he is wholly dependent.

His school GCSE won't be accepted. He needs to pass a B1 level test with a UKVI approved test provider.
