Hi

I have got my ILR in March 2017 on 10yr long stay rule, I was on Tier 2 visa before and as my 10yrs came before Tier 2, 5years I have gone down the long resisdancy route. My wife is on tier 2 dependant visa which is to expire in 2019. My question is Do I need to apply for her new ILR dependant visa using FLR(M) or I can let her Tier 2 dependant continue, also if I need to apply FLR(M) does she need to do English language test i.e. SELT A1/A2 test?

Any help is appreciated. Thanks

She needs to switch to FLR(M). It is not possible for her to apply for ILR as a tier 2 dependent.

FLR(M) will be a new 5 year route (2 x 2.5 year visas) before she will qualify for ILR based on 5 years residence on FLR(M) spouse visa.

She needs to meet the English test requirement for FLR(M) and the financial requirement of £18,600pa assuming there are no non British children.

She will also have to pay £500 IHS plus the FLR(M) visa application fee.
