Tier 2 ict and general

Friends,

I am currently on ICT tier 2 visa and wondering if I can apply for tier 2 General visa as below :

Wait for expiring of initial 3 years of ict visa,
Go back to India after that,
And IMMEDIATELY apply for general visa from India.

Key question is that, does the 12 month cooling off period would still be applicable in this situation or not?

12 month cooling off applies to you unless your new sponsor pays you more than £159,600 per annum.
