Tier 2 ICT Dependant to Tier General

Hello Team,

I have a query if you could please help me with.

I am currently working on a Tier 2 ICT Long Term Visa and my term ends on January 2018.
My Wife is currently on a Tier 2 ICT Long Term Dependant Visa and is working in UK.
My Wife's employer wants to provide sponsorship letter for switching from Tier 2 ICT Dependant to Tier 2 General.
The queries I have are :

1. Would she need to go to India and then apply for switching the visa from Tier 2 ICT Dependant to Tier 2 General or can be done from UK ?

2. After that is done, when I apply as Tier 2 General Dependant of her, would that also need to be done from India and hope there is no cooling off period or any other stuff ?

1. She can only apply from home country.

2. You can apply in the UK once she returns with a tier 2 general.

Thanks a lot. It would be helpful if you can let me also know-

1. If my wife wants to apply through premium service (10 days processing time) to switch to Tier 2 general from ICT Tier 2 Long Term Staff Partner, would she still need to apply from home country?

2. Applying from home country - does that mean online submission (filling up online) has to happen from home country? How long it might take? The time gap between switching to another visa, does that interfere with her employment (can she still work remotely for the employer)?

3. According to point based system does she need to appear for English language efficiency, inspite of the fact that she had English Language and Literature as major (Honours Graduate) and did her schooling in English Medium? If she still need to prove her efficiency in English Language, where should she apply?

1. She can ONLY apply from home country. There is no other option.

2. Nothing to do with her employment continuing. Presumable the full and proper RLMT has been done BEFORE she is offered the job and CoS issued to prove she has not been pre-selected??

3. She needs to meet the English language requirement for Tier 2 General. Either IELTS SELT from an HO approved test provider or UK NARIC ELA red route if her degree is non UK one. They both cost the same price.
