Spouse Visa

Post by Loopylou20 » Wed Aug 23, 2017 1:08 pm

I'm not sure if I've posted this in the right place so please forgive me if I haven't

I need advice on spouse visas.
We only have an Islamic marriage not recognised by law, but I am planning to make our marriage recognised by law so I need help with two different things
I Islamic married him whilst he was over here (U.K.)on a tourist visa... I want to make our marriage lawful in U.K. So someone told me about a marriage visa? Can anyone explain?
And as for spouse visa
Can anyone advise on route for this?
I claim carers allowance and universal credit
My carers is 62ish a week. I have a dependent child and get 20.70 child benefit for her. On universal credit my last payment was 821. Out of that 821, 450 is rent, 150 is carer element (used to be the income support premium) and the rest of it is what used to be child tax credit so 221
I pay 17 council tax per month.
So as far as I'm aware I have more than the income support couple level each week. But would that be different rules because I have a dependant child? I'm very confused because of me having the child would I have to have extra money?

Your 'marriage' is not recognised in the UK so for immigration purposes, you are not married.

How long has your 'partner' been in the UK on a tourist visa?

When does the visa expire?

What was the purpose of the visit and duration stated in his tourist visa application?

Did your partner declare you as his partner in his tourist application?

Your partner is unable to switch to any other visa category within the UK as a tourist. They will have to return home to apply for either a fiance visa (valid for 6 months to get married) or a spouse visa if already married (through registry office).

To get married in an HO approved Registry office, you have to give 28 days notice and your partner has to present his passport and visa status to do so. The Registry office then have an obligation to inform HO who can then extend the notice period to 70 days to investigate and/or interview each of you separately before giving permission to marry.

This still does not mean your partner can apply for a visa within the UK and partner will still need to return home to apply for a spouse visa.
