Salary requirement for ILR of tier 2 dependent

Post by jinny3101 » Fri Aug 25, 2017 1:24 am

hi,
I'm really confusing now and hope someone could help me.
I have tier 2 PBS dependent visa from March 2013 up until August 2018. However my husband had already change his visa to ILR since August 2016. As fas as I understand I have to have 5 years continuous leave in order to apply for ILR on March 2017 so I did not apply for ILR at time he applied. Once he got his ILR, I continue to stay under my current visa which is Tier 2 PBS dependent. And here what I'm confusing are:

1. When I apply for ILR, do I have to show my husband salary (even when he is currently on ILR)? And if so is there a minimum requirement?
2. Do I have to show our saving for the last 90 days before applying for ILR? If so what is the requirement?

I would really appreciate if someone could help me. Thank you in advance.

Thank you for your help. However I'm still confusing by the letter that one of the person I know have applied for the ILR from being dependent visa. She got her visa refused which the reason stated on the paper is :

For the purpose of paragraph 287 (a)(v) Adequate and adequately in relation to the maintenance and accommodation requirement for partners shall mean that , after income tax, national insurance contribution and housing cost have been deducted, there must be available to the family the level of income that would be available to them if the family was in receipt of income support.
Therefore when considering the your application for ILR the following calculations detailing has been used to determined whether you can adequately maintain your family without recourse to public funds
A-B greater than or equal to C
Where A is the projected income( after deduction of income tax and council tax, and contribution)
B is what need to be spend on accommodation and council tax and
C is the amount of income support an equivalent British family of that size can receive.

Please help me what do they mean by that. Since you are saying my husband salary and our saving are not needed.

Thank you in advance.

If your 'friend' applied for ILR based on a SPOUSE SETTLEMENT VISA, it is a different visa category and rules to PBS Dependent.
