Advice on my wife's current circumstances

Hello, this is my first time posting here, so apologies if I make any mistakes in my presentation.

My girlfriend came to the UK attempting to gain asylum seeker status due to sexual abuse in her past that was not acknowledged by authorities. This failed, and so she was appealing that verdict.

At the start of this year, she was detained while attending a meeting with her adviser, and was deported from the UK shortly afterwards. She left voluntarily, and so received the short one year ban.

Since then, I have moved to her country of origin (Mauritius) where we have gotten married, but we would like to return to Britain where we both feel our true homes really like. There is a section of her disbarring document that states that she could return to the UK to visit family members before that year is completed.

As we are now married, could she visit me on a tourist visa if I returned to the UK?

We would like to get her a spousal visa, and I have the means to get a job earning well over the required salary, but would prefer not to spend the 6 months apart until my jobs salary would be applicable.

If you require any more information, I would be happy to supply it.

Unlikely she will get a visit visa to visit her spouse in the UK. Unfortunately many in the past have abused this way of getting into the UK and then attempting to apply for the spouse visa once here.

That aside, the 1 year ban usually includes visit visas.

Your best option would be to apply for a spouse visa when you qualify.

Yeah I assumed that might be the case. I'm guessing that we would only find out that she would not be able to obtain a visit visa on point of entry?

Would she be able to obtain a visit visa after her year disbarring is up do you think?

Still difficult as what reasons of ties to home country would she give if her husband is in the UK?

Visit visas are heavily scrutinised, even more so for an applicant with a blemished immigration history.

Also, as she has the ban, she should (if she was going to) apply for a visa before travelling and not enter as a visa waiver national (which I think Mauritius is).

I'm guessing the fact that the rest of her family lives in Mauritius wouldn't be enough?

Thanks for the advice. Applying beforehand would make much more sense, as at least we would know whether she could return before we got on the flight.
