Uk Tier 2 recipient divorcing dependent

Post by tngo2000 » Sun Aug 27, 2017 10:09 am

I recently arrived in the UK as a dependent of a UK Tier 2 visa holder. I have only been here for a month and my husband has now decided to divorce me after almost 20 years of marriage. I have already received my BRP. Can I remain in the UK and will I be able to work?

Thank you.

No, not on a tier 2 dependent visa. You either have to find a visa you qualify for or leave the UK.

Your husband must inform HO on the prescribed form that the relationship has broken down and your visa will be curtailed/cancelled.

I recently got a job as a bakery chef at a bakery. Will the bakery have to sponsor my UK Tier 2 visa for me to stay in the UK. Will they have to incur the costs?

Thank you in advance for your reply.

Yes, a company has to sponsor you if you want a Tier 2 General visa and it must be an HO approved sponsor and the job must be at NQV6. Yes there are costs involved (immigration skill surcharge is one) and they have to do a full and proper RLMT before they can issue you with a CoS (if they are an approved sponsor). You also have to apply from your home country.
