Main Applicant Tier 2 to ILR... Dependents?

Post by KG123 » Thu Jan 14, 2016 9:21 am

Hi
Am currently on Tier 2 General PBS VISA.
My first Tier 2 was granted on February 23rd 2011. I've changed my job then and been issued a fresh Tier 2. So, my qualifying period for applying Settlement is by 23rd February 2016. I believe we can apply 28 days earlier for Settlement.
My wife first Came to UK in July 2013 under Tier 2 General, PBS Dependent. Her current VISA is valid until 18th July 2017.
If I apply for settlement in UK for myself now, do I need to apply any VISA for my wife? or can she continue with the same VISA she has got currently? I believe my Employer would cancel sponsorship as soon as I got ILR and if my wife continues on the same TIER 2 General Dependent VISA, is that still legal ? Wouldn't be any problem, (specially if we are travelling) at Air port Immigration.
If I change my job after my ILR, would that effect my wife VISA. If she is allowed on the Same VISA, i can then apply Extension for her under same Tier 2 General PBS Dependent Category in July 2017, so that she can have a Valid VISA until she is eligible for settlement. Please advice me.
Some one told me if I switch my wife's VISA category her clock starts again and needs to live further 5 years to be eligible for settlement. Please advice me.

ILR supercedes your Tier 2 G. Your employer doesn't have to do anything as your Tier 2 will be invalidated once ILR is granted.

Your spouse can continue to extend as a PBS Dependent until she has 5 years residence and qualifies for ILR. She can stay on the visa if you change jobs. Her visa is dependent on you, not your sponsor.

Visa extension for dependant after main applicant ILR

Post by KG123 » Fri Mar 24, 2017 11:02 am

Hi,

My issue is, i was on Tier 2 when my wife came to UK (she came in 2013 July). Last year I got ILR and i have now applied for British Nationality/Naturalization and UK Passport. (Applied on 6th February 2017 and awaiting the outcome from Home Office)

My wife is still on Tier 2 Dependant Visa and her Visa expires in July this year. Since it is less than 5 years for her to be in UK, she is still not eligible to apply for ILR. In this regard, she wants to apply for an Extension under the same category as Tier 2 Dependant for another 2 years.

Can she legally allowed to do that?
Which form should she be using to apply for?
Do I need to submit any of my documents, as I am no longer on Tier 2 any more?

Please reply.

Thanks
KG

In this regard, she wants to apply for an Extension under the same category as Tier 2 Dependant for another 2 years.
She will get an extension for 3 years, not less than that. She also has to pay the £600 immigration health surcharge PLUS the visa fee.
Can she legally allowed to do that?
Yes it is permitted in the immigration rules. The advice has NOT changed since you asked the same question last year January. immigration-for-family-members/main-app ... l#p1291969
Which form should she be using to apply for?
Online form only. https://visas-immigration.service.gov.u ... nt-partner
Do I need to submit any of my documents, as I am no longer on Tier 2 any more?
Read the guidance notes.

See also Explanatory Memorandum. It's legal, provided you were granted ILR under the 5-year PBS route.

Think mine is a similar case where the IHS charge is showing GBP 1700. Any idea how to get this changed to GBP600 ? I am applying for my daughter for PBS dependent for 3 years and i recently got ILR thru Tier 2 route.

Please ask your questions in your own topic rather than tagging onto someone else's thread. Child must apply alone.

Tier 2 Dependant Extension category

Post by KG123 » Wed Jul 26, 2017 6:58 pm

Hi
Sorry can't find the exact match for my query.
I have submitted application for Extension visa for my wife under Tier 2 Dependant category. We were also asked to submit the Biometrics from UKBA home office, which she has done in the post office.
She is continuing in her job and now her Employer is asking proof that she can legally allowed to work in UK while her application is under process.

We have submitted the Biometrics last weekend and waiting for the outcome of the application. How can we submit a proof to the Employer that she is legally allowed to work in UK ?

Please some one help advising us.

Thanks

If she applied before her visa expired, she is covered by Section 3C which means her existing/previous visa conditions continue.

The employer can also check her right to work status using the Employer Checking Service online.

Also, please refrain from starting new topics or tagging onto other members topics. I have merged all your posts in THIS topic.

Spouse Visa Extension

Post by KG123 » Sat Aug 26, 2017 9:34 pm

Please accept my sincere apologies if this message shouldn't be mentioned here,

I applied for Tier 2 Dependant Extension visa for my wife in July 2017. While filling online application, I have been advised to pay for Immigration health surcharge for 2.5 years ( as she needs only 1 year visa to eligible for ILR. So I paid 500 GBP, yesterday we got message stating her application is on hold and need paying another 100 for IHS fee. we paid 100 and got confirmation. Now we got an email from
noreply@visas-immigration.service.gov.uk asking her to sign into her application. We logged into the application, gave the new IHS payment reference number, but it is taking thru Payment section asking to choose payment method. But I have already paid 677 for postal application in July, but it is now asking again to pay by choosing either standard service or premium service..Should I need to pay again?
What should we do and how should we proceed. Please suggest and help us.

Thanks
