Hi,

I am a British Citizen and my girlfriend is an American citizen. She is on a Tier 4 Student visa and once it expires we plan on going down the spousal visa route.

Her parents live in the USA and are curious as to how they could eventually live in the UK and what the best pathway for them would be, they are married and nearly both in their 60s.

Do they have any hope for living in the UK?

She needs to apply before her student visa expires if she is applying to change to spouse visa within the uK.

They would have to find a route they qualify for. The Adult Dependent Relative is the most difficult visa to get and highly likely to be refused, which will also shut the door to any visits to the UK as their intention to settle will be known.

CR001 has already advised that the Adult Dependent visa is extremely difficult to obtain. In order for your fiancee's parents to qualify, they would have to prove that they BOTH need daily care for simple tasks such as bathing, dressing, preparing food etc., and that the care either isn't available in their home country, or is unavailable.

As you are probably well aware, the 'nearly' 60's aren't considered as elderly. Perhaps they have a particular skill and qualify for a Tier 2 visa. :idea:
