Dear Forum members,
My kids have recently got British citizenship as their father has ILR.
I am still on Tier1 Entrepreneur Visa and due to apply for ILR in December 2018. Have 2 full time employees and business has no turn over.
1: I wonder if we can apply for child benefits/tax credits?
2. Can my husband claim any housing benefits?
2: Will any benefit claim on my husband's name affect my ILR?

Yes. Child benefit in HIS name only and tax credits in JOINT names.
2. Can my husband claim any housing benefits?
If you qualify and your combined income is low enough. He must get single plus child rate.
2: Will any benefit claim on my husband's name affect my ILR?
Not if you claim correctly and you must declare your income and his income.

1: Do children become eligible for child benefits as one of their parents get ILR provided they are born in UK?
2: If yes to above, can i claim up to 3 months back?
3: Do i need to send only Birth Certificates for kids and Dad,s ILR. Or i also need to send their original passports? Any idea, how long it takes them to return original passports as i intend to travel by end october?

Children DO NOT claim the benefit, the PARENT who has ILR claims the benefit.
2: If yes to above, can i claim up to 3 months back?
It will only be back dated to the date of ILR grant as before that, he was not eligible for benefits.
3: Do i need to send only Birth Certificates for kids and Dad,s ILR. Or i also need to send their original passports? Any idea, how long it takes them to return original passports as i intend to travel by end october?
Birth certificates, passports and dad's ILR/passport - all originals. It doesn't take long to get back.

Hi CR001,

I think we dont need to include anything to claim 3 month backdated child benefits claim. I did tick that my husband was under immigration control six months back (He was granted ILR 5 months back). I left next question blank which asks if he was under immigration control in last 3 months, enter date of ILR approval. Does it automatically makes them believe that it has to be backdated to 3 month?

Not always no. Complete everything required, they will disregard what they need to. You must list the date he was granted ILR and what matches his BRP card.
