Claiming Council Housing

Good Day! Can anyone help me about getting a council flat. My husband is british we have a 6 yrs old son british citizen and im on a spouse visa status with no recourse to public fund, since i dont have recourse to public funds the main applicant is my husband is there any problem about our housing application will it be affected by the type of visa i have or since my husband is british he can claim benefits like applying for the council housing will they consider our applucation base on our circumstances rather than my immigration status im not claiming benefits.
Please help me thank you!

Your husband can only be considered for Council housing as a single person with a child.

But do you not need income of at least £18600 if you are on spouse visa?

@casa yah just like what my family service worker told me my husband can apply for a council housing, thanks

Still waiting for a reply from my solicitor for an answer about this matter but still no answer from him. So so confused.

What bruteforce is referring to is that for the spouse visa and ILR based on 5 years on a spouse visa, you are required to show a minimum income of £18,600pa (excluding benefits) and that you can maintain yourselves without recourse to public funds.

@CR001 he works fulltime with gross annual income of £28,000 excluding overtime. We already received an offer from the council just waiting for the keys to turnover to us and sign the tenancy agreement. During the time when we are applying to be in a housing list im in a process of renewing my visa the housing officer told me that the application will be under my husbands name, before im on an eea resident permit holder coz my husband is an eea national as well but when i renew it they refused me for the reason that my husband is a british citizen also we reapply for flr/fp visa and grant me a 30 month spouse visa with no public funds. What im worried about if the housing officer ask for my visa and find out that i have no recourse to public funds will they cancel the offer that they given to us? Our grounds for applying for a council housing is due to overcrowding and at the same time medical reason for my son? This are the questions that my solicitor to answer me, but our social care worker told me that my husband can apply but im not be part of the contract but still can live with them as part of the household. Thank you.

Your social care worker is correct, but you should make the Local Authority aware that you are under Immigration control and without access to Public funds.

In the circumstances, this shouldn't affect the decision to provide you with Council accommodation in your husband's name.
