PBS dependent with work restriction

Post by stevas13 » Thu Sep 07, 2017 3:13 pm

Hello,

I, currently hold PBS (Tier 2) dependent visa with restricted work - no training as doctor. I came to UK in Jan 2014 and have completed 3 yrs 9 months of my stay. My husband just got his ILR in Sept 2016. I'm nearing my extension period. I worked so far as doctor in non-training post. I hope to apply for Post-graduation training post later this year. I have few questions

1. Is there a possibility that once I get the offer letter, I will be able to remove the restriction staying in UK by submitting the training conditional letter as proof ?
2. I'm aware that i might have to go back to my home country to remove the restriction, then what visa should I apply ( meaning: can I continue being PBS dependent or do I have to apply for new visa with my university sponsoring for it )
3. Would you suggest I just go ahead with FLR(M), as my husband is ILR visa - being aware that it would reset my clock for ILR to 5 yrs while I can Qualify for it in 1yr3months if i remained in PBS dependent.

Many thanks in advance.

My understanding is that you cannot have this restriction removed as a PBS Dependent, either in the UK or from home.
2. I'm aware that i might have to go back to my home country to remove the restriction, then what visa should I apply ( meaning: can I continue being PBS dependent or do I have to apply for new visa with my university sponsoring for it )
You would likely have to apply for the appropriate visa.
3. Would you suggest I just go ahead with FLR(M), as my husband is ILR visa - being aware that it would reset my clock for ILR to 5 yrs while I can Qualify for it in 1yr3months if i remained in PBS dependent.
Your choice to be honest and only you can make the decision. FLR(M) will give you the freedom but at the cost of a new 5 year residence period. OR you could defer what you want to do until you have ILR.

Many thanks for your advise.

I have one simple question. I know this might sound ridiculous, but would like to clear it. I might be mis-guided by my solicitor. who confused me on the appropriate form to fill. I opted to change my visa to FLR(m) or dependent to husband who has ILR to pursue my career. Which form am i suppose to fill - Set(m) or Set (o) form. ?

If you want to switch to FLR(M), then FLR(M) is the appropriate form.
