10/07/17

We have been looking at it backwards and we thought it was October. Due to financial and birth of my 2nd, we were unable to apply in June even if we knew the correct date

Can we take the FLR (FP) to the premium service center?

Yes FLR FP is fine. She might not get a decision on the day though.

Same in my wife's country as well and since I have a disability, I'm kind of hard at reading things right and I don't really know the difference.

So, we can apply and take the FLR (FP) forum at the premium service center?

we will take our 2 kids to show our family and can't there be any sympathetic decision to allow my wife another 2.5 year extension instead of 10? and will it be ok if we also take our FLR (M) with us and ask them to also check that forum?

You can by all means take both the FLR(M) and the FLR(FP) forms with you to the appointment but it's unlikely that the FLR(M) application will be accepted and very doubtful that a decision will be made on the day.

The junior level of the PSC caseworkers doesn't give them the authority to make a decision on an application that is considered to be complex and it will generally be passed to a more senior Case Worker for consideration. This will mean that a decision will be put on hold for further investigation.

So, they will consider both the FLR (M) and the FLR (FP) at the premium center? and we state our reasons why my wife overstayed and we plead with them to consider the FLR (M)

Will they consider approving the FLR (M) if our reasons are valid? we have a lot of hospital letters to say my wife was pregnant and she needed to have a ceaserrean during June. My wife wasn't fit to go out or do much with the visa at that time and it took me over a year to save up the money and I've finally saved up the right amount this month.

I just don't want to wait another 10 years

Your wife's pregnancy and lack of funds is unlikely to sway the Case Workers decision. Applications are approved or refused according to the Immigration Rules, not under compassion.

Is there any advise you could give me that I can use to get the caseworker to consider the FLR (M) forum

I really don't want to wait another 10 years. That's kind of depressing and my wife won't see her family and her family won't see her or their grand kids

Even under the 10 year route to settlement, your wife would be free to travel. :idea:

Would she need to wait 10 years before applying for Indefinite Leave to Remain? or, can she apply for that before 10 years?

FLR(FP) is a 10 year route to ILR (4 x 2.5 year visas).

She can at anytime when she meets the requirements, switch to FLR(M) 5 year route (2 x 2.5 year visas).

A solicitor called me earlier and quoted over £600. I was considering it

Could a Solicitor help us with applying for a successful FLR (M) forum? would that be a smart decision?

I need to hear something up-lifting or something that can change my spirits into positive thinking, because it feels like all hope is lost, because I seriously can't afford to pay the 10 year route 4 separate times. It took me over a year to save up for this and we really needed to make sacrifices to save up this money

If my wife's FLR (FP) forum gets approved. How soon can she change to a 5 year route FLR (M)?

and how do you do that and what kind of documents, requirements do we need to provide?

I will list all the documents we have that we will be taking with us to the premium service center

6 month bank statement (my name)
NPower - Covering the last 2.5 years (my name)
TalkTalk - Covering the last 2.5 years (my name)
02 bills - Ranging from the last few months (my name)
Housing benefit award (my name)
Council Tax award (my name)
Healthy start vouchers - Ranging from the last few months (my name)
Maternity Grant refusal letter (my name)
Disability Living allowance statements and awards (my name)
Employment and support allowance statements and awards (my name)
2 "To whom it may Declare" letters from my GP and my Neurologists doctor to state my Disability (my name)
Water Bills - Covering the last 6 months (me and my wife's name)
Child Tax Credit statements and awards (me and my wife's names)
Council Tax - Covering the last 2.5 years (me and my wife's names)
Previous address Tenancy Agreement (me and my wife's names)
Current Tenancy Agreement (me and my wife's names)

I was told by a couple people that the Premium service won't be good for my wife because she overstayed.

Can you clarify if this is the truth? and can you also reply to my last question?

Premium service should only be used for non complicated cases. Overstaying can be seen a complicated. If you do use premium service, you might not get a decision on the day and you will pay the premium fee for what will become a postal application.

You will have to pay again (IHS fee and visa fee) to switch to FLR(M), so how soon you do that depends on your finances.

Your documents seem fine, see comments below on your additinal documents.
And here are additional documents we have

No. You pay extra for premium service, £590 plus the visa fee. If you don't get a decision on the day, which is likely, you would have already paid premium fee for a postal application.

Yes, if all the requirements are met but her overstay might cause a delay.

What if after she is approved the FLR(FP) 10 year route and we wait 1 or 2 months, then, we pay the premium service application fee again to apply for the FLR(M) will she get a decision that day?

At the premium center, will they still treat her the same as they would have by postal application service? and will they still take her biometric information?

You have to pay the £590 premium service fee, the visa fee of £900 odd plus the £500 IHS fee again if you apply for FLR(M).

I would suggest wait a bit on FLR(FP) before applying for FLR(M).

The damage is already done with the visa already expired, she will have to start again from scratch in terms of residence towards ILR.

Yes her biometrics will be taken etc but unlikely you will get a decision on the day for the FLR(FP). It all depends and no one can tell you what will happen on the day.

If she gets put on the 10 year route, we don't want too wait too long. As soon as we have money, we want to change to the FLR(M) straight away
