Claiming child tax credit

Post by MYA » Sat Sep 09, 2017 4:18 pm

Good afternoon

Dear respected member

I need a help and suggestions on your best knowledge and experience on my following situation;

I was on Tier 1 entrepreneur visa in August and I have my partner and two children's as my dependant.
But on 1st September 2017, I managed to get ILR on the basis of long residency. Iam going to apply for the registration of my children for citizenship next week and on FLRM I will apply for my wife visa as a dependant of settelled person in few months.

Now I have a question that I want to apply for child tax credit on the basis that I have ILR, but while filling the tax credit form I come to know that they are asking all the details of my partners income and when my application will approve it comes on both my and my wife's name.
If I took the child tax credit, then obviously my wife is not allowed to have public funds but Iam allowed to.
My question is that when I will apply for my wife's extension on FLRM in few months time , can home office raise the objections that you and your wife are taking child tax credit for that wife is not allowed public funds,
What will be the scenario? Please reply comprehensively as I don't want to risk my wife future application as she has not access to public funds.
I read the tax credit form it shows both of the parent names in their child tax record

Please give me suggestions is it ok for us to apply for child tax credit or I have to wait until my wife got ILR.

Regards
MYA

Your wife's future visa applications won't be refused due to a CTC claim, but this MUST be claimed in JOINT names as all income in the household is used to calculate the entitlement.

Child benefit should be claimed in your name only.

CTC is about the only benefit not affecting ILR or visa extension if claimed jointly. You cannot claim CTC as a single person if you are married and living with your spouse. If you do, this is benefit fraud/deception.

Thanks CR001. Your reply is more to the point as compared to casa , could you please give me any reference to the homeoffice guidance, or HMRC guidance or any link about you just said
"CTC is about the only benefit not affecting ILR or visa extension if claimed jointly."

Rest I know about CTC on HMRC website what CTC is and all that.
