Help with Form MN1, section 1.3

Hello,

I came to the UK in 2001 with my husband who is a German citizen. Our children (twins) were born in the UK in 2004 and I became a citizen of the UK via the EU route in 2010. I am now looking to register the girls under Section 1(3) of the British Nationality Act.

Regarding question 1.3, we never applied for the girls to have indefinite leave to remain as we believed it to be unnecessary. Since 2010, their father has had 2 stints of working abroad, but we stayed here. He is currently in Brussels. (We are separated by not divorced.)

As I understand it, an EU citizen has a declaratory right of ILR after residing in the UK for 5 years. I was told I should put the 5 year anniversary of their birthday as the date for 1.3, but this was of course not "granted". On your forums here, there is some uncertainty as to whether I need to give a date for 1.3 at all.

Would you please advise how to handle 1.3?

Children born in the UK do not require PR or ILR to register as British. They have an entitlement to register.

Leave 1.3 blank.
